The service
SuperMarketer is the online service operated by the administrator of the supermarketer.com service. It reads your website and your answers to onboarding questions, keeps a brand brief, builds marketing plans, drafts blog articles, social posts, email campaigns, ad copy and SEO fixes, publishes approved items through channels you connect and reports results. Contact for anything about these terms is support@supermarketer.com.
We may improve, change or remove features over time. If a change materially reduces what your paid plan includes, we will tell you by email before it takes effect.
Your account
- You must be at least 18 years old and give a valid email address that you control.
- You are responsible for keeping your sign-in details safe and for everything done in your account, including by people you invite.
- Seats are for named individuals. Sharing one seat between several people is not allowed.
- Tell us at support@supermarketer.com without delay if you suspect unauthorized access.
Subscriptions and plans
SuperMarketer is sold only as a subscription. You choose a plan, Starter, Growth, Scale or Enterprise, billed monthly or yearly, and the subscription renews automatically at the end of each period at the then current price until you cancel. Prices are shown on the pricing page before you pay, and taxes may be added where required. The one-time homepage demo is the only part of the service offered without payment, and it is limited to one plan preview.
Plan limits and usage
Each plan includes monthly limits, such as the number of brands, social posts, blog articles, email campaigns, ad copy variants, AI images, connected channels and seats. Limits reset at the start of each billing period, and unused amounts do not carry over. Usage counts when an item is generated, so deleting, rejecting or regenerating an item does not return the usage it consumed. We may apply fair technical limits on request rates to keep the service stable for everyone.
Upgrades, downgrades and billing changes
When you move to a higher plan or from monthly to yearly billing, we charge the difference for the rest of the current period immediately, and the new plan becomes active once that payment succeeds. If the payment fails, your current plan stays in place. When you move to a lower plan, the change applies from the next billing period and no part of the current period is refunded.
Payments, refunds and chargebacks
Payments are processed by our payment operator. By subscribing, you authorize recurring charges to your payment method for each period until you cancel. Payments are final, with the limited exceptions described in our refund policy. If a renewal payment fails, we may retry it and may limit or suspend the account until it is paid.
If you believe a charge is wrong, contact us first at support@supermarketer.com. Opening a chargeback or payment dispute without contacting us first is a breach of these terms. We may suspend the account while a dispute is open and may provide records of your account and usage to the payment operator to respond to it.
Cancellation
You can cancel at any time in your account billing settings. Cancellation stops future renewals. Your plan stays active until the end of the period you already paid for, and the account then moves to a read-only state for 30 days so you can export your content, after which workspace content may be deleted. You may also close your account and request deletion of your data at any time, as described in our privacy policy.
Acceptable use
You agree not to use SuperMarketer to:
- send spam, unsolicited bulk messages or email to lists without a lawful basis or consent where it is required;
- publish false, misleading or deceptive claims, including fake endorsements, invented results or impersonation of people or brands;
- create content that is unlawful, defamatory, harassing, hateful or that infringes intellectual property or privacy rights;
- break the rules of the platforms you connect, including the policies of social networks, email platforms and ad platforms;
- attempt to access other accounts, probe or overload the service, reverse engineer it or resell it without our written agreement;
- generate content involving minors in any sexual or harmful context.
We may remove content or suspend an account that breaks these rules.
You are responsible for what goes live
You decide what is published. Items you approve, and items published by channels you set to Auto-publish after 24 h or Full autopilot, are published on your instruction and under your responsibility. You are responsible for checking that content is accurate, lawful, fits your industry rules and meets the requirements of each channel. You can change the autonomy setting of any channel back to Review everything at any time.
Content ownership
You own the inputs you provide, such as your brand information, answers and uploads, and the outputs generated for your account, such as plans, drafts, images and reports, to the extent the law allows ownership of such content. You give us a limited, non-exclusive license to host, process, copy and transmit your inputs and outputs only to provide, secure and support the service for you. We do not use your content to train public or general-purpose models, and we do not use it to market our service without your permission. Similar outputs may be generated for other users, because AI can produce similar text from similar inputs, and you do not acquire rights in another user's outputs.
AI output needs your judgment
Plans, drafts, images and reports are generated by AI and may contain errors, outdated information, wording you dislike or claims that need checking. They are suggestions for your review, not professional legal, financial, medical or tax advice. Results such as traffic, leads or sales depend on many factors outside our control, and we do not promise any particular result.
Connected channels and third-party services
When you connect a website, social profile, email platform, ad account or analytics tool, you authorize us to access and act on it within the permissions you grant. Those services are run by third parties under their own terms. We are not responsible for their availability, changes to their interfaces or policies, or actions they take on your accounts. You can disconnect a channel at any time.
Suspension and termination
We may suspend or terminate your account if you breach these terms, fail to pay, open a payment dispute without contacting us, create risk for other users or the service, or if the law requires it. Where reasonable, we will tell you first and give you a chance to fix the issue. If we terminate the service for reasons that are not your fault, we will refund the unused part of any prepaid period.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We work to keep the service available and secure, and Enterprise plans include the uptime commitment stated on the pricing page, but we do not guarantee that the service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim related to the service is limited to the fees you paid us for the service in the 3 months before the event giving rise to the claim. These limits do not apply where the law does not allow them, including liability for fraud or for death or personal injury caused by negligence.
Indemnity
You agree to defend and indemnify us against claims from third parties arising from content you publish through the service, your breach of these terms or your breach of a connected platform's rules.
Changes to these terms
We may update these terms. We will change the date at the top, and for material changes we will notify account holders by email at least 14 days before they take effect. If you do not agree with a change, you can cancel before it applies.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in Delaware, and both parties consent to their jurisdiction. If you are a consumer, nothing in these terms removes rights you have under the mandatory laws of the country where you live.
General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your account or these terms without our consent, and we may transfer them as part of a merger or sale of the service. These terms, together with the privacy policy, the refund policy and the cookie policy, are the entire agreement between you and us about the service.
